PARISENCHERES is a voluntary sales company of furniture by public auction governed by the law n°2000-642 of July 10, 2000.

acts as an agent for the seller. The auctioneer is not a party to the sales contract which is exclusively between the seller and the buyer

Generalities
The present general terms and conditions of sale, the sale and all that relates to it are governed by French law; the sellers, the buyers as well as the agents of the latter accept that any legal action falls under the exclusive competence of the courts of the jurisdiction of Paris (France).
The provisions of the present general terms and conditions are independent from each other. The sale is made in cash and the prices are expressed in euros (€

Guarantees
The seller guarantees PARISENCHERES and the buyer that he is the undisputed owner, or that he is duly mandated by the undisputed owner, of the goods offered for sale, which are not subject to any claim, dispute or seizure, nor any reservation or pledge, and that he can validly transfer ownership of said goods.
The information appearing in the catalog is established by PARISENCHERES and the expert who assists it, if necessary, with all the diligence required by a VSC of furniture at public auction, subject to the notifications, declarations, rectifications, announced at the time of the presentation of the object and recorded in the minutes of the sale. The
absence of any indication of restoration, accidents, retouching or any other incident in the catalog, on condition reports or labels, or in verbal announcements, does not imply that an item is free of defects
.
Gemstones and pearls in general may have undergone general beautification practices (oiling for emeralds, heat treatment for sapphires or rubies, bleaching for pearls)
.
These enhancements are considered traditional and are accepted by the international gemstone and pearl trade.
Customers may request a certificate for any uncertified stones by sending a request to the Jewelry Department at least two weeks prior to the sale date.
No guarantee is made on the working condition of the watches
. As
some watchmakers no longer have the original parts for the restoration of antique watches, no guarantee is given to the buyer on the restoration by the watchmakers for watches sold as is.
For items whose low estimate exceeds €1,000, a condition report on the state of conservation of the lots may be provided on request. The information contained therein is provided free of charge and for information purposes only. PARISENCHERES cannot be held responsible in any way for the information
contained in the report.
In the event of disputes, notably concerning the authenticity or origin of the objects sold, PARISENCHERES is bound by an obligation of means; its possible responsibility can only be engaged on the express condition that a personal and proven fault is demonstrated against it.
No claim will be admitted once the auction has been pronounced

Estimates and prices
The estimated selling price is shown next to each lot, it does not include the buyer's expenses or the VAT

Conditions of participation in the auction
Purchase orders must
be
placed
no later than 2 working days before the sale.
Telephone bids are only accepted for lots with a low estimate of more than €400.
Purchase orders and telephone bids are a free service provided to the client. PARISENCHERES, its agents or its representatives will not be held responsible for any error or omission in the execution of the orders received, nor for the non-execution of the latter.
Bidding process
The bids follow the order of the catalog numbers. PARISENCHERES is free to set the order of progression of the bids and the bidders are obliged to comply with it.
In the event that a reserve price has been stipulated by the seller,
PARISENCHERES reserves the right to bid on behalf of the seller until the reserve price is reached.
It is important to note that in-room bidding takes precedence over online bidding.
No in-room, telephone or internet bidding will be accepted by the auctioneer if it is announced after the word "sold" has been pronounced.
Lots marked with an * are sold by the auctioneer's staff or by an expert of the sale

Buyers' Fees
The buyer will pay to PARISENCHERES, in addition to the hammer price, a buyer's commission of 28.8% VAT included (24.00 VAT excluded)
VAT is at the rate of 20% and 5.5% for books.
Goods in temporary admission from a country outside the European Union will be indicated by the symbol
